State files response in motion to quash

NORMAN — The Cleveland County district attorney’s office filed a response Monday to a defendant’s motion to quash charges of first-degree murder, shooting with intent to kill, robbery with a weapon and conspiracy.

Kurtis Blake Southerland, 28, of Thomas, filed the motion to quash April 4. The motion states that sufficient evidence was not adduced at the preliminary hearing to establish that a crime had been committed. The state’s responding motion said otherwise.

“Detective Doug Hurst testified as to statements made by each of the defendants, including Kurtis Southerland,” the response said.

Southerland was charged conjointly with two others in September 2012 for the death of Jonathan Patton at the Cleveland County residence. His co-defendants include Stacy Buckmaster, 26, and Gilbert Paz, 38, both of Weatherford.

While Southerland initially denied any knowledge of the crimes alleged, he eventually admitted to being present at the crime scene. Southerland had a discussion with his co-defendants regarding the location and purpose of their plan. They then obtained a vehicle, purchased gloves, took the vehicle to the location and walked to the trailer where the crimes took place, discharging a firearm at the scene, the document states.

The three defendants went to the Oklahoma City residence in Cleveland County in September 2012 after Buckmaster told the two men she believed the home would be easy to rob because of the lack of surveillance cameras and firearms, according to affidavits. She had been to the home several times to purchase narcotics and had seen several thousand dollars inside the trailer, an affidavit said.

Buckmaster and Paz have already pleaded guilty on all counts, court records show. Formal sentencing for Buckmaster is set for 1:30 p.m. April 30 with District Judge Tracy Schumacher. Formal sentencing for Paz is set for 1:30 p.m. May 28 with Schumacher.

A jury trial for Southerland will be June 9 in Cleveland County District Court.
