Norman man convicted of two counts assault and battery

NORMAN — A Norman man who was in an officer-involved shooting last year near Main Street and Hal Muldrow Drive was convicted last week after entering guilty pleas.

Richard Darwin Eaton, 46, who lived on Hal Muldrow Drive at the time, pleaded guilty July 7 to two counts of assault and battery with a deadly weapon in Cleveland County District Court.

Records show that Eaton received 20 years in prison for each count, to be served concurrently.

Just before the shooting, Eaton demanded $40, assaulted and injured a female employee May 1 at a Wendy’s Restaurant, according to witnesses and an affidavit. Witnesses observed a knife in his hand.

Within minutes, a Norman police officer found Eaton walking on Hal Muldrow. When Eaton saw Officer Glenda Vassar, he walked quickly toward her, records show.

Vassar observed the suspect holding a knife and issued verbal warnings. She then retreated to a position of cover. Eaton continued to come toward her, so she fired three shots and Eaton fell to the ground.

During an interview with police, Eaton said that he had walked to the restaurant to kill the female employee, records show. The woman sustained a facial laceration during the incident.

Eaton also disclosed that he made the decision to approach the first officer who contacted him with the knife, the affidavit said.

Eaton has been previously been convicted of assault and battery with a dangerous weapon, two counts of second-degree burglary, two counts of forgery and uttering a forged instrument in Oklahoma and Pottawatomie counties.
