Two charged after allegedly trying to escape penitentiary

NORMAN — A failed attempt to climb over a perimeter fence at the Joseph Harp Correctional Center in Lexington led to felony charges Wednesday in Cleveland County District Court.

Brandon Wayne Brown, 38, of Lexington, and Jonathan Andrew McCubbin, 31, of Warr Acres, were charged with attempting to escape from a penitentiary together.

The case has been under investigation for about eight months; the incident occurred Oct. 25. Around 2:15 that morning, Sgt. Jeremy Penner and Cpl. Josh Kimbrell saw the two approach the perimeter fence with a makeshift ladder, according to the affidavit filed with charges.

As the officers moved toward the two men, Brown put the ladder on the fence and began to climb as McCubbin stood at the bottom. When the ladder broke, Brown fell to the ground. McCubbin then ran to another area of the fence and began to climb but got tangled in the razor wire, the affidavit said.

Perimeter officer Cpl. Robert Jones and Penner then ordered McCubbin off the fence and he ultimately surrendered, the document states. Both Brown and McCubbin were placed in custody and escorted to a secure area of the facility.

“Brown later confessed he ‘rigged’ the cell door, began monitoring the perimeter officers’ movements and threw the ladder out the window,” the affidavit said. “He further admitted he proceeded out of the cell land unit doors, climbed over the wall leading to the garden and carried the ladder toward the fence.”

Brown had also written a note that was found at his classroom workstation which read, in part, “Bye Dizzy Nate Ms. Bunyard. Thanks for everything. You guys are awesome! I should not be here. I got to go,” the document states.

Brown and McCubbin have both been previously convicted of, or pled guilty to, several counts of child sexual abuse.
