Second teen pleads not guilty to murder charges

An Oklahoma City teenager accused of killing his girlfriend's father in January pleaded not guilty to murder charges Thursday afternoon in Cleveland County District Court.

Oklahoma City defense attorney Brooke Tebow entered the plea on behalf of her client in District Judge William C. Hetherington Jr.'s courtroom.

Fox, 18, was charged Jan. 29 with first-degree murder in the stabbing death of Leroy Herrera. Fox's girlfriend, Brittany Leeann Herrera, 16, also has been charged with first-degree murder in relation to her father's death.

Enid defense attorney Stephen Jones has been hired to defend Fox. Tebow is an associate of Jones. She also represented Fox at his June 8 preliminary hearing.

Assistant District Attorneys Susan Caswell and James Siderias are prosecuting the teens.

Judge Hetherington set Fox's trial for the Nov. 16 jury trial docket.

Tebow said Hetherington scheduled the trial for Dec. 7, but it could be rescheduled for a later date.

At a preliminary hearing in June, Special District Judge Michael Tupper ruled enough evidence existed to try the teens in the death of Leroy Herrera, 41.

The teenagers are accused of killing Leroy Herrera Jan 24, in the family's home on Hiwassee Road in far southeast Oklahoma City.

A medical examiner's report showed Leroy Herrera was stabbed twice in the neck. One wound measured 9 centimeters deep and another wound was 10 centimeters in depth.

Fox and Herrera were found and arrested in Fort Worth, Texas, almost a week after the death. They are being held at the Cleveland County Detention Center on $500,000 bond.
