Who keeps up the right-of-way?

Norman city councilmembers plan to consider an ordinance at Tuesday’s regular meeting that will clarify language in the City’s Right-of-Way Maintenance Program.

The primary responsibility for rights-of-way remains with the adjacent private property owner.

“Rights-of-way in Norman have been maintained by a variety of groups including the City, the University of Oklahoma, Cleveland County, the Oklahoma Department of Transportation, Norman Public Schools and private property owners,” wrote revitalization manager Linda Price in a memo to council. “All will continue to maintain certain areas, but the responsibility for rights-of-way will remain with private property owners.”

Councilmembers also will consider individual pedestrian gates in perimeter fencing that backs to the street to allow passage of individuals and lawn mowers to access to right-of-way for maintenance.

Councilmembers also will consider the final report of the Enforcement Authority, after a majority of authority members voted to accept council candidates’ filings on contributions and expenditures.

There were concerns expressed at the EA meeting July 2 about the timing of some contributions to unsuccessful Ward 2 candidate Chebon Marshall’s race, with 40 percent of his donations coming in after the last required filing at noon Friday before the municipal election.

There also will be consideration of a rezoning request and preliminary plat from A+ Mini Storage LLC from local commercial district to general commercial district and granting special use for a mini storage on a 2.14-acre tract of land at the southeast corner of 48 Avenue SW and Main Street.

Councilmembers plan to have an executive session to discuss the acquisition of real property associated with the West Main Street and 36th Avenue NW widening project and the City of Norman vs. Sutton Creek Development LLC in Cleveland County District Court.
