Derrick Everett Haggard, 26, of Newalla, has been charged with felony counts of unlawful cultivation of marijuana, possession of firearm while in commission of a felony.

The Cleveland County District Attorney's office has filed criminal charges against a Newalla man who is accused of cultivating marijuana behind his father's residence.

Derrick Everett Haggard, 26, of Newalla, has been charged with felony counts of unlawful cultivation of marijuana, possession of firearm while in commission of a felony. Prosecutors also charged him with unlawful possession of paraphernalia, a misdemeanor.

A Cleveland County Sheriff's Department employee said Haggard was being held in the county jail Wednesday afternoon on a $31,000 bond.

According to a court affidavit, at about 1:25 p.m. Tuesday, investigators with the District Attorney Street Crimes Unit went to 19000 Skyridge Road to speak with Haggard's father, Derrick Wayne Haggard, about anonymous information they received about illegal narcotics at his residence.

"While speaking with Mr. Haggard's son, the defendant admitted that he had a marijuana cigarette in his pocket," the affidavit stated.

As investigators spoke with Derrick Everett Haggard, he admitted that he had about six marijuana plants inside a trailer behind his father's residence, according to the affidavit. Officers located 64 "marijuana plants inside containers that were approximately six inches tall."

"The defendant stated that he resides in the small camp trailer next to the trailer the marijuana plants were in," the affidavit stated.

Haggard told officers there was a pipe that he smoked marijuana in lying on a table near the bed, according to the affidavit. Investigators found the pipe and a double barrel shotgun hanging above the front door.

Officers arrested Haggard at the scene and transported him to the Cleveland County Detention Center, the affidavit showed.
