NORMAN — Mississippi man charged in a 1982 rape case is in police custody. Arrested on Monday, Gilbert Duane Harris, was taken to Harrison County Adult Detention Center in Biloxi, Miss.
Harris cannot make bond as he is on hold for Oklahoma, Lt. Christopher De Back of the Biloxi Police Department said. Harris was charged as a suspect in a 32-year-old rape case by the Cleveland County District Attorney's Office.
Another man was wrongfully convicted in this case and spent more than 13 years in prison. DNA evidence exonerated the wrongfully convicted man, reported the Oklahoma Watch.
An affidavit attached to the charge alleges that the assault occurred in an apartment in the 1100 block of Biloxi Drive, east of OU campus.
Charged with first-degree rape and forcible sodomy, Harris awaits an extradition hearing before he can be transferred to Oklahoma, De Back said and added that normally after an extradition hearing the state has 10 days to collect the suspect.
