Plaza Towers parents file against city, Moore schools

NORMAN — Tort claims were filed against the city of Moore and Moore Public School District earlier this month by parents of Plaza Towers Elementary School children who died during the May 20, 2013, tornado.

Claims were filed by family members for Emily Conatzer, JaNae Hornsby, Christopher Legg, Nicholas McCabe, Kyle Davis and Sydney Angle. An additional claim was filed for Luci Conatzer, Emily’s sister, who was injured at the school during the tornado.

Many of the claims stated that the city and school district failed to implement and follow established safety protocols and procedures for the safety and well-being of Plaza Towers students.

One of the claims states that Davis was instructed to crouch down next to an interior wall in Plaza Towers’ separate third-grade center where he and six of his classmates were killed. The center was built in 2005, the document said.

Additionally, the city and school district failed to hire, retain and supervise qualified architects, engineers and contractors to construct the classroom addition to the elementary school to ensure the building was safety constructed, including but not limited to following all applicable building and safety codes and or architectural or engineering plans, several claims state.

A majority of the claims asked for the maximum amount of compensation the state statute will allow, but two asked for compensation in excess of the limits.

Angle’s parents asked for compensation of $1 million. Davis’ mother, Nikki, asked for compensation in excess of the maximum limit of $175,000 with a list she wished to be compensated for, including the following:

· Medical and burial expenses of her son

· Loss by Nikki Davis of anticipated services and support

· Loss by Nikki Davis of companionship and love of her son

· Destruction of Nikki Davis’ relationship with her son

· Loss of monies expended by Nikki Davis in support, maintenance and education of her son
