Man avoids prison time on child molestation charges

NORMAN — A 75-year-old Oklahoma City man avoided prison time and was put on probation for at least 25 years Friday for committing multiple sex crimes against children.

Under a plea agreement with prosecutors and the defense attorney, District Judge Tracy Schumacher found James Donald Swindle Sr. guilty and sentenced him to probation on six separate charges. He also must register as a sex offender.

Swindle was originally charged in September 2012 with 14 sex crimes involving young girls. The incidents were investigated by Oklahoma City police and charges filed in Cleveland County.

Swindle pleaded no contest to the six charges, and Judge Schumacher found him guilty on all counts. The case was set for jury trial Monday. A civil lawsuit also has been filed against Swindle.

In her order, Judge Schumacher noted the “extremely unusual circumstances wherein the District Attorney’s Office would offer probation without incarceration in a sex offense.”

Swindle received 10 years probation and a $50 fine for one count of procuring lewd or indecent acts with a child younger than 16. On five counts of lewd and indecent acts with a child under 16, he received 20 and 25 years of probation and $50 fines.
